Terms & Conditions

Roles

The 'Client' refers to the person who is directly in contact with Cactus Events. The 'Celebrant' refers to the person who the event is for. It is recognised that the Client is not necessarily the Celebrant. Cactus Events will communicate only with the Client, providing all required information, pricing and conditions of hire in writing, before taking payment.

Payments & Safety Deposit

All payments must be paid via bank transfer. Please always use your invoice number as the reference.

You will receive a copy of the Terms & Conditions before receiving the invoice. T&C's should be signed electronically before making payment. In the case that a payment is made before T&C's are signed, this payment will be considered as your initial acceptance of the T&C's.

Cactus Events requires a £60 safety deposit for all events. This payment is not included on the invoice, and is to be made separately from that of the total price of the event. The safety deposit must be transferred before the event takes place. Should any items be damaged or missing, repair/replacement costs will be deducted from the safety deposit. Stock count and quality control will be performed, and the safety deposit returned within 48 hours, providing all is correct.

Responsibilities (of the Client)

  • The Client is responsible for communicating with Cactus Events and for all payments made both before and after the event (should additional costs apply).

  • The Client is responsible for providing all guests' medical conditions and/or allergy/dietary requirements to Cactus Events a minimum of 14 days before the event.

  • The Client is responsible for ensuring that all information provided is accurate, as Cactus Events takes no responsibility for mistakes made on the Client's part.

  • The Client is responsible for ensuring that the event space is dimensionally suitable, and is ready for set up on arrival. Should the space not be ready, Cactus Events takes no responsibility for any delays caused.

  • The Client is responsible for respecting all hire times, including delivery and collection.

  • The Client is responsible for any additional charges made to Cactus Events including but not limited to tolls, low emission zones, congestion charge, etc. It is understood that these charges may occur after the event takes place.

  • Once the equipment has been set up it must not be moved. If any issues arise during the event, the Client should contact Cactus Events immediately.

  • The Client is responsible for the care of all equipment provided, ensuring not to damage or lose any items. Costs of any damages or loses will be deducted from the safety deposit. Costs will depend on damage or replacement needs.

  • The Client is responsible for the safety of all guests and the supervision of all children while using the equipment provided.

  • The Client is responsible for ensuring that food is not consumed in any teepees/frame.

  • The Client accepts that all events are non-smoking, and any damage caused to equipment due to smoking will incur a £250 penalty fee.

 

Responsibilities (of Cactus Events)

  • Cactus Events is responsible for providing all required information including dimensions, pricing and conditions of hire in writing, prior to taking payment.

  • Cactus Events is responsible for performing a risk assessment for all events.

  • Cactus Events is responsible for providing, setting up and dismantling all equipment and ensuring said equipment is in safe, clean condition.

  • Cactus Events is responsible for respecting all hire times and for ensuring the set up is ready and later collected at agreed time.

  • Images of themes and designs are provided for inspiration - actual designs are likely to vary. Cactus Events holds the right to modify any design or equipment should it be deemed necessary for any reason, without the need to advise the Client. Cactus Events will always endeavour to provide a like-for-like substitution.

  • Cactus Events takes no responsibility for any damage, injury or loss that takes place during the event, nor during the set up and take down.

  • In the case of no damages or loses, Cactus Events is responsible for returning the safety deposit to the Client within 48 hours of the collection time.

  • Cactus Events respects all copyright laws and it is not the intention of Cactus Events to ever copy any theme or design. All designs created and images used are personal property of Cactus Events, and are inspired by trends and culture.

Cancellations (by the Client)

  • Cancellations with more than 30 days' notice: fully refundable

  • Cancellations with more than 14 days' notice: holding deposit forfeited, safety deposit refunded, 50% refund issued on any additional monies paid.

  • Cancellations with less than 14 days' notice: safety deposit refunded, all other monies paid are non-refundable.

  • Cancellations made on the day of or after the date of the event are non-refundable.

  • Cancellations of any out-sourced extras once paid, are non-refundable.

  • The postponing of an event incurs a penalty fee of £30 and rescheduling will be subject to availability. If no new date can be arranged, cancellation policy applies.

  • If at any point an event is postponed due to the severe sickness of the Celebrant and a certified doctor's note is provided, Cactus Events will waive the £30 penalty fee and reschedule at no additional cost to the Client, subject to availability. If no new date can be arranged, the holding deposit will be forfeited, and a 50% refund issued on any other monies paid.

Cancellations (by Cactus Events)

  • Cactus Events holds the right to cancel any event at any given time without the need for justification. Cactus Events will endeavour to notify the Client with as much notice as possible and will rebook on another occasion at no extra cost, as long as the new date is within 11 months of original event date.

  • Any event cancelled by Cactus Events is fully refundable to the Client. In case of cancellation, Cactus Events will refund the client within 5 working days.

  • Cactus Events is not liable to pay any compensation to the Client, the Celebrant, or any other person or service for any loss arising directly or indirectly from any cancellation.

  • Cactus Events holds the right to cancel any event at any given time should any of these conditions be breached by the Client.

Force Majeure

In the case of unforeseeable circumstances preventing someone from fulfilling a contract, Cactus Events does not accept any responsibility for losses or other costs incurred as a result of any of the following: acts of God including fire, flood, storm or natural disasters, war, sabotage or acts of terrorism, government sanctions, labour disputes including strikes, lockouts, boycotts or other industrial action, failure in the transportation of equipment or in the provision of services.
